The former makes little sense considering the purpose of the system. The only thing I can conclude is that there are factory programming differences between the two models ,or the previous owner reprogrammed it, (doubtful).
This is in contrast to my 04 325i which has its valve shut at idle, and opens as throttle is applied. However, when connected as it should be, the car is annoyingly loud at idle (I have race headers). When sucked on, the valve closes and the car is sleeper mode (sounds stock). There is vacuum in the line up to the solenoid in the trunk, and I have verified the valve is not stuck by sucking on the tube which operates it. I have tested the solenoid which operates when 12v is applied. Open valve at idle, and I'm assuming all the time, as I have no way to get out and look with the vehicle in motion. I have a 330i manufactured 11/02 which also exhibits the same behavior.
